CMC "OZ Artist Of The Year 2008" competition
Terms and Conditions


Entry into the competition

  1. Entry into the CMC “Oz Artist Of The Year 2008” competition (the “Competition”) is open to all residents of Australia who are over 18 years of age. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”).
  2. To be eligible to win the major prize and vote for their favourite CMC Oz Artist of the Year, entrants must be residential subscribers of FOXTEL and AUSTAR. Entrants who are not a residential subscriber of FOXTEL or AUSTAR are eligible to vote for their favourite CMC Oz Artist of the Year, but will not be eligible to win the major prize.
  3. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, AUSTAR, Optus TV and their related bodies corporate are not eligible to enter.
  4. The competition to win the major prizes commences on Monday 19th November 2007 at 09:00am (AEST) and finishes on Sunday 13th January 2008 at 11.59pm (AEST) (the “Competition Period”). All votes submitted during the Competition Period will go into the draw to win a major prize.
  5. Entrants will be voting for their Top 20 CMC Oz Artists of the Year during the “Competition Period” to decide who will be the CMC Oz Artist of the year.
  6. To enter the Competition and be eligible to win, entrant’s must go the CMC website (www.countrymusicchannel.com.au) (the “CMC website”), register for membership and submit an online entry form nominating their favourite CMC Oz Artist of the Year. Voting will be capped at 1 entry per member per day.
  7. All entries must the entrant’s vote, name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth to be eligible for entry. Incomplete entries or those with defamatory or offensive content will be ineligible. It is the entrants’ responsibility to inform the Promoter if their residential address, email address or phone number changes during the competition period.
  8. The use of any automated entry software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited.

PRIZES

There is one major prize package. The prize package includes:

  1. 2 x return domestic economy airfares from Major Prize winner’s nearest capital city to Tamworth valued at a maximum of $5,000;
  2. 2 x nights’ accommodation in Tamworth in a 3 star apartment for 2 people valued at a maximum of $500;
  3. 2 x General Admission tickets to attend the CMAA (the “Event”) to be held at the Regional Entertainment Centre in Tamworth, NSW (the “Venue”) on Saturday 26th January 2008 valued at a maximum value of $100 per ticket.
  4. Meet and greet with Steve Forde and Shea Fisher at the event. Collectively referred to as the “Major Prize”.

  1. The total Major Prize pool is valued at $5,700. The Major Prize is subject to availability and the terms and conditions of the entities supplying the elements of the Major Prize and must be taken on dates specified by the Promoter. The Promoter is neither responsible nor liable for any change in the value of the Major Prize occurring between publishing date and date the Major Prize is claimed. All Major Prize values are in Australian dollars.

  1. 1.The Major Prize is not transferable or redeemable for cash. The Major Prize or any element of the Major Prize cannot be exchanged for any other prize. The contents of the Major Prize will be at the Promoter’s sole discretion. The Major Prize is subject to availability and the terms and conditions of the entities supplying the Major Prize.

JUDGING AND AWARD OF PRIZE

  1. The Major Prize winner will be drawn at random from all valid competition entries received during the Competition Period. The draw will take place at 5th Finger Level 9, Tower Building, Australia Square, 264 George St. Sydney, NSW, 2000 on Monday 14th January 2008 at 12:00pm (AEST). The Major Prize winner will be contacted by email or phone and in writing on Monday 14th January 2008, and their name will be published in The Australian newspaper on Wednesday 16th January 2008. The details of the Major Prize winner will also be published on the CMC website from Tuesday 15th January 2008. The Major Prize must be claimed by 9:00 am on Monday 21st January 2008 in order to avoid the date of the Prize from passing.

  2. If the Major Prize winner cannot be contacted despite every reasonable effort by 5pm on Monday 21st January 2008, the Promoter shall conduct such further draws as may be deemed necessary at 5th Finger Level 9, Tower Building, Australia Square, 264 George St. Sydney, NSW, 2000 on Tuesday 22nd January at 9:00pm (AEST) in order to distribute the unclaimed prize to coincide with start of the event. The winner of the unclaimed Major Prize will be contacted by telephone and their details will be published in the Australian Newspaper on Thursday 24th January 2008. In the event that the winner(s) previously drawn are from SA, this draw will occur on Monday 14th April 2008 at 3:00pm (AEST) at 5th Finger, Level 9, Tower Building, Australia Square, 264 George St. Sydney, NSW, 2000. The Prize winners will be contacted by phone and in writing, and their names will be published in The Australian on 21st April 2008.

  3. If the Major Prize winner cannot be contacted or does not claim the Major Prize by the stipulated date, then the Major Prize will be forfeited and a substitute prize will not be offered in lieu of the Major Prize.

TRAVEL

  1. It is a condition of entry that Major Prize winner and their guest must be available to travel to Tamworth on the date specified by the Promoter in Clause 7 to coincide with the date of the Event.

  2. In the event that the Major Prize winner is a resident of the Tamworth region, (which shall be determined in the absolute discretion of the Promoter), the flight component of the Major Prize will be forfeited in full and no substitute will be offered.

  3. All ancillary costs incurred in taking and using a Major Prize (including but not limited to meals, mini bar, additional spending money, insurance and taxes) are the responsibility of the Major Prize winner and their Guest. Unless expressly stated as being part of a Major Prize, all other expenses are the sole responsibility of the Major Prize winner and their Guest.

GENERAL

  1. The Major Prize winner is advised that Tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of the prize.

  2. It is a condition of accepting a Major Prize that the Major Prize winner and their Guest may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

  3. Subject to state regulation approval the Promoter reserves the right to refuse to allow the Major Prize winner or his or her Guest to take part in any or all aspects of the Major Prize, if the Promoter determines, in its absolute discretion, that a Major Prize winner or his or her guest are not in the mental or physical condition necessary to be able safely to participate in the Major Prize.

  4. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as a Major Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that a Major Prize winner cannot provide suitable proof, the Major Prize winner will forfeit the Major Prize in whole and no substitute will be offered.

  5. No responsibility will be taken by the Promoter, CMC, FOXTEL, AUSTAR or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Major Prize winner from winning the Prize.

  6. Subject to relevant state authority approval, the Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Major Prize to vary, postpone or cancel the Competition or the award of a Major Prize including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):
    (a) the Major Prize winner did not satisfy the Competition entry requirements; or
    (b) the Promoter cannot conduct the Competition for any other reason beyond its control.

  7. Subject to relevant state authority approval, in the event that the Promoter cancels the Competition, postpones, varies or withdraws the Prizes it shall not:
    (a)be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, postponement, variation or withdrawal; and
    (a)be required to conduct the Competition at any other time.

  8. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Competition database and NOT time of transmission by the entrant. It is each entrant’s responsibility to inform the Promoter if his or her contact details change during the Competition Period. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.

  9. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.

  10. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Major Prize or entering the Competition.

  11. All entries become the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes, subject to the Promoter’s privacy policy which is available at www.countrymusicchannel.com.au. By entering the Competition, the Major Prize winner agree to the use of their name, image, audio-visual recording and/or photograph/s, without compensation, and agree that the Promoter will own copyright in any such images, audio-visual recordings and/or photograph/s.
